1. Flooring
1.1 General notes on floor coatings
The coating system offered conforms to the existing surface evenness of the substrate. Existing hairline cracks, filled cracks or mortared joints can lead to new cracks in the coating system when the substrate moves. Sliding mechanical loads lead to wear marks. Surface changes during the service life due to natural wear, unforeseen loads or stresses from non-operational conditions and — unless otherwise stated in the offer — discolouration due to chemical or UV exposure are not covered by the warranty. To reduce usage-related wear and extend service life, floor surfaces must be subjected to basic and maintenance cleaning.
1.2 Substrate requirements
The substrate must be load-bearing, dimensionally stable, firm, free of loose particles, dust, oils, greases, rubber abrasion and other adhesion-impairing substances. The adhesive tensile strength of the substrate must average at least 1.5 N/mm² (minimum individual value at least 1.0 N/mm²), compressive strength at least 25 N/mm². Substrates may be slightly damp but must not show a film of liquid and should not be exposed to major temperature fluctuations (vapour pressure). In this case, double priming is generally required. Substrates must be protected against rear moisture penetration during use. Note: Floor coatings cannot eliminate or stop pre-existing damage in the substrate (e.g. moisture penetration, osmosis, decomposition or alkali-silica reaction). The coating applied by us is not a waterproofing membrane in the sense of DIN 18195 / DIN 18356. The coating serves only to protect the surface of the concrete slab. We therefore accept no liability for pre-existing substrate damage and resulting consequential damage.
1.3 Underfloor heating
When surveying the property, the operator or owner must declare the presence of underfloor heating. In the event of missing or incorrect information, euro-top GmbH accepts no liability for consequential damage to the floor coating. If underfloor heating is present: the underfloor heating must be switched off at least 2 weeks before floor coating begins. After floor renovation, the underfloor heating should initially (for approx. 2 weeks) be operated at low temperatures only. We recommend keeping a heating log.
1.4 Note on LED wheel guides
In the case of existing LED wheel guide rails, de-/installation before and after floor coating is arranged or coordinated by us via the plant manufacturer for warranty reasons.
1.5 Floor area measurement
In car wash bays, pits are deducted at 75%. In car wash lanes (from a length of 22.0 m), pits or chain shafts are deducted at 100%. Smaller drains and Aco drainage channels are not taken into account.
1.6 Elastic joints = maintenance joints
Elastic joints are maintenance joints exposed to strong physical influences, whose sealants must be inspected and if necessary renewed at regular intervals to avoid consequential damage. Repair or renewal of elastic joints is therefore not a warranty claim.
2. Wall and ceiling cladding
2.1 Notes on cladding work
In the case of insufficiently insulated exterior walls and ceilings, there is a risk of heat build-up between the wall/ceiling and cladding, especially in heated rooms. To prevent condensation, adequate ventilation and insulation must be provided before cladding installation. Heating and water pipes running beneath the cladding must be wrapped with insulation material. Note: Old pipework or objects that are no longer required are often installed. If you can have these removed beforehand, this saves considerable unnecessary time during cladding installation. Important: If various electrical components and/or supply lines CANNOT be routed behind the cladding, these must be secured on site with suitable protective devices. We reject any liability for damage resulting from non-observance.
2.2 Legal notice
If the integrity of the wall and ceiling cladding — and its joints to the floor and ceiling — against service water from the operation of washing systems is questioned, the types and properties of building waterproofing are defined by the relevant standards (DIN 18195 series). Our wall and ceiling claddings do not meet any of the required waterproofing types. To prevent negative water influence on the building fabric, appropriate on-site measures must be taken before any wall and ceiling cladding. These may include: bitumen or polymer bitumen sheets, plastic sheets of PIB or ECB, metal strips in combination with bitumen sheets or with mastic asphalt, etc.
3. General
3.1 Portal system
The portal system must be operational during renovation work to ensure accessibility in all areas.
3.2 General requirements for tile coating
Surfaces to be coated must be dry, firm and free of adhesion-impairing substances such as grease or wax residues. No adhesion is achieved on silicone — silicone joints and residues must be completely and carefully removed. Any damage to tiles or joints must be repaired with filler. Joints must be protected against rear moisture penetration, as subsequent detachment and/or blistering cannot otherwise be excluded.
3.3 Alternative items
Alternative items are not included in the total offer price. They serve only as price information. Only unit prices are given for alternative items. Only the base item, not the alternative item, is included in the final offer total. At the latest upon placing the order, the client shall determine which service item is to be executed.
4. Acceptance and condition assessment
The client must accept the service upon completion. Unless otherwise agreed (e.g. a formal acceptance via acceptance protocol), acceptance also takes place through commissioning of the work or, if the contractor has set the client a deadline for acceptance, upon expiry of that deadline. The contractor has the right to partial acceptance of self-contained parts of the service prior to final acceptance. Acceptance may not be refused on account of insignificant defects.
5. Weather conditions
5.1 General notes for painting/outdoor work
In the event of unsuitable weather and drying conditions, the contractor may suspend work. The duration of the suspension extends the execution period. Work shall be continued under suitable weather conditions, taking into account appropriate organisation and set-up times.
5.2 Billing
Billing is based on actual measurement and effort.
6. Guarantee
6.1 Warranty
For all work (excluding painting): warranty period of 5 years under VOB Part B. For all painting work: warranty period of 2 years under VOB Part B. For all supplied electrical components: warranty period of 1 year. Note: Mechanical damage caused by external influences not consistent with the intended use is not covered by the warranty. The warranty period begins with acceptance and is the period within which defects in the service may be claimed (limitation period). Damage caused by improper use, damage or processing by third parties or by other circumstances not attributable to the contractor is not covered. Wear and signs of ageing based on contractual use and/or natural, particularly weather-related wear are not defects. They may occur before the end of the warranty period. This applies in particular to all coatings of metallic surfaces and wood outdoors and to coatings exposed to strong local climatic stresses.
6.2 Place of performance
Place of performance is the registered office of the contractor.
7. Place of jurisdiction
Place of jurisdiction, unless otherwise agreed, is Hannover (Lower Saxony). Our offer is based on the VOB in its most current version. For the work listed in the bill of quantities, the provisions of VOB Part B — general technical regulations for construction services, in the respectively valid edition including supplements — shall apply. In the event of contradictions in the bill of quantities, the general provisions of the VOB shall prevail. Our offers are valid for 6 weeks from the offer date. Upon acceptance of the offer, the offer prices remain valid as contract prices for a further four months if the start and completion date of the measure is not yet known at the time of offer submission. If a material change (greater or less than 0.75%) in the cost calculation basis in the area of labour costs subsequently occurs, the offer price shall increase or decrease proportionately. Subject to individual proof by either party, the price change is 0.85% per 1% change in labour costs. If the completion date is known at the time of offer submission, the offer prices apply until that date and increase after a further two months according to the above parameter.
